The following are the terms and conditions for use (the "Terms") of MC-HRsolutions web site (the "Site") and Costello and Associates HR Consulting Ltd. (the “Company”). Please read the Terms carefully.
By using MC-HRsolutions resources (as defined below) you are deemed to accept the validity of and be bound by the Terms as stated herein without modification. MR-HRsolutions resources are defined as any documents, letters, forms, contracts, products, programs, web links, email, information, or any other resources and services provided by the Site or the Company, including the partial use of the Site or the Company resources.
MC-HRsolutions™ is not a law firm and does not provide legal advice (as defined below). Your use of the Site or any of the Company’s services does not create a solicitor-client relationship between you and MC-HRsolutions™ or Costello and Associates HR Consulting Ltd.
You agree that all decisions you make on legal matters are your full responsibility and you agree to retain legal counsel licensed to practice in your jurisdiction regarding any legal issue of enough importance to reasonably require it.
You agree that MC-HRsolutions does not provide legal advice. If you receive any communication from MC-HRsolutions™, its agents, its employees or any other associated entity, which is legal advice, you agree that it is NOT a communication authorized by MC-HRsolutions™ and you agree to immediately delete and disregard it.
Except as expressly provided in these Terms, you agree to accept full responsibility for determining the value of and for any use you make of MC-HRsolutions™ resources, and for obtaining any needed assistance from a properly licensed attorney to assess the value of and appropriate uses for any MC-HRsolutions™ resources.
For the purposes of these Terms, legal advice is defined to include the following:
You agree not to use any MC-HRsolutions™ resources for any purpose which is against any law in your jurisdiction or for any purpose which would not give full effect to the Terms, even if that purpose is otherwise allowed under the Terms of this agreement.
You may view the Site using a web browser for evaluation purposes as a potential customer or supplier.
Unless otherwise stated, the On-Line Consulting service is governed by the Terms.
MC-HRsolutions™ retains the right to make changes to its resources as it sees fit.
To the maximum extent allowable under applicable law, except as explicitly identified in these terms, you agree not to publish, re-publish, lend, license, give away, look at the software source code, modify the software source code, post to an Internet web site, or use in an automated system any MC-HRsolutions™ Resources, nor will you allow or assist a third party to do so.
The rights granted under these Terms are granted to you only.
If you are an organization, a resource purchase allows one individual within your organization to exercise the rights granted by these Terms. If multiple individuals within your organization require access, a resource purchase must be purchased for each individual. The appointed individual may not be changed.
MC-HRsolutions™ retains the right to prohibit organizations, groups, or individuals from using its websites or MC-HRsolutions™ resources at its discretion.
This agreement cannot be assigned.
MC-HRsolutions™ DOES NOT transfer to you title to any copy, or original, of the documents or any other MC-HRsolutions™ resources. All ownership, copyright and other intellectual property rights to any MC-HRsolutions™ resources belongs solely to MC-HRsolutions™ except as expressly licensed in these Terms.
Without reducing or restricting any other remedies that MC-HRsolutions™ may be entitled to, you agree that to the extent allowable under applicable law any automated system using any MC-HRsolutions™ resources will be the property of MC-HRsolutions™.

Except as expressly provided in these Terms, to the maximum extent permitted under applicable law, MC-HRsolutions™ resources is provided "as is" without any kind of warranty. Guarantees, as outlined in the MC-HRsolutions service description are an exception to this article.
You accept full responsibility for determining whether MC-HRsolutions™ resources is suitable for any particular purpose and for protecting yourself against any possible consequential damages.
Except as expressly provided in these Terms, we are not responsible for any loss, injury, claim, liability, damage, or consequential damage related to your use of MC-HRsolutions™ resources, or for inaccessibility of MC-HRsolutions™ resources whether from errors or omissions in the content of MC-HRsolutions™ resources or any other linked sites or for any other reason. Use of MC-HRsolutions™ resources is at your own risk.
MC-HRsolutions™ does not represent or warrant that MC-HRsolutions™ resources, its server or any linked sites are free of any harmful resources.
Except as expressly provided in these Terms, the maximum liability of MC-HRsolutions™ is the amount paid to MC-HRsolutions™ by the customer.
The amounts specified in this section are the limits to any guarantees provided in any MC-HRsolutions™ resources. Guarantees and refunds are limited to the amount the paid for the resource.
All of the Terms are valid regardless of the heading. To the maximum extent possible, the Terms take precedence over any conflicting MC-HRsolutions™ resources.
The user agrees to indemnify and hold MC-HRsolutions™, its directors, officers and employees, harmless from any claim, demand, or damage, including legal fees, asserted by any third party due to or arising out of the user’s use of the Site or MC-HRsolutions™ Resources.
MC-HRsolutions™ reserves the right to change the Terms or policies regarding the use of the Site at any time and to notify you by updating the Site. Other terms and conditions are only valid when signed in writing by an authorized MC-HRsolutions™ officer.
The invalidity or unenforceability of any provision of these Terms will not affect the validity or enforceability of any other provision of these Terms and such invalid provision will be deemed to be severable.
These terms and conditions constitute the whole agreement between you and Costello and Associates HR Consulting Ltd., which is the owner of the MC-HRsolutions™ trade name, brand and trademark.
No failure or delay, on the part of MC-HRsolutions™, in exercising any right or power under these Terms will operate as a waiver of such right or power.
The Terms are governed by the laws of the Province of British Columbia in Canada. You consent to the exclusive jurisdiction of the courts of the Province of British Columbia, Canada.
While the advice and resources provided by MC-HRsolutions.com and Costello and Associates HR Consulting Ltd. are given with the intention of helping your business and your managers’ deal with your human resources issues in an ethical, legal and responsible manner, it is not legal advice. It is the best advice we can provide based on experience and related knowledge. Our advice is provided to help you limit your liability, but we cannot guarantee that our advice will eliminate liability, and therefore, Costello and Associates HR Consulting Ltd. cannot be held responsible for the actions, or lack thereof, of any clients or client representatives. It is the sole responsibility of the user/purchaser of any Costello and Associates HR Consulting Ltd.
